Johannesburg, a city known for its potential and diversity, is grappling with a pressing issue – the detrimental effects of inefficient urban management. The city's disregard for its residents, particularly in providing essential public services such as water, not only violates their basic rights but also undermines the city's progress, echoing a violation of the very constitution that should protect them.
1. Violation of Basic Rights: Inadequate Water Services
One of the most glaring consequences of Johannesburg's inefficiency is the lack of adequate water services. As guaranteed by section 27 of the South African Constitution, every citizen has the right to access sufficient water. However, the city's neglect has resulted in erratic water supply, leaving residents without this fundamental necessity. The violation of this constitutional right not only jeopardizes public health but also perpetuates inequality, disproportionately impacting marginalized communities.
2. Constitutional Duty: A Call for Accountability
Johannesburg's failure to provide consistent water services highlights a larger issue – a breach of its constitutional duty to its citizens. The Constitution of South Africa mandates that local governments ensure the well-being of their residents by providing essential services, such as water, in a fair and sustainable manner. The city's inefficiency in this regard not only undermines its credibility but also erodes public trust in its ability to fulfil its obligations.
Johannesburg's urban management inefficiency, especially concerning water services, not only disregards the basic rights of its citizens but also violates the constitutional principles that form the foundation of South Africa's democracy. Here is a matter that our firm has recently dealt with regarding the inadequate water services being provided by Johannesburg water: A diligent effort was made to serve an urgent court order on the Municipal Manager, aiming to ensure compliance with its explicit directives. The order unequivocally instructs both the City and Johannesburg Water to promptly reinstate the water supply. Furthermore, it designates a specific return date, during which the court will assess any potential contempt and authorize an arrest warrant if necessary.
Yet, bewilderingly, the city has chosen to disregard the order's relevance to the Municipal Manager. This stance is demonstrably false, as substantiated by the attached court order. The Municipal Manager is distinctly named and subjected to sentencing, and the stipulations articulated for the city are inextricably linked to his responsibilities.
The City's refusal to acknowledge service and its denial of the Municipal Manager's involvement are not only obstructive but also grievously undermine the very foundations of legal processes and accountability. This behaviour corrodes public trust and severely weakens the underpinnings of justice within our society.
Yet despite efforts, the City or Johannesburg Water have still refused, rather failed to reinstate the water supply. Only furthering the contempt and the need to seek the enforcement of the order through the arrest of the Municipal Manager.
This once again leaves the public with a lack of trust in the municipality due to the continuous inadequate public services being provided.
